OTHER FAMILY MIGRATION

Please note that from 15 October 2007, all applicants aged 18 and over are required to sign the Australian Values Statement when applying for selected visas. The Australian Values Statement is a new visa requirement that requires applicants to confirm that they will respect the Australian way of life and obey the laws of Australia before being granted a visa.

For most visa applicants the Australian Values Statement is included in the application package.

For those who use old forms/packages that do not include the Australian Values Statement, they are required to sign the “Long” Australian Values Statement (Form 1281). Form 1281 can be obtained at the Australian Visa Application Centres, the Visa and Citizenship Section of the Australian Embassy in Hanoi or the Visa and Citizenship Office of the Australian Consulate-General in Ho Chi Minh City.

Please also note the requirement to have read or had explained to you information provided by the Australian government before signing the values statement. This information is contained in the Life in Australia book. Currently, this book is available on the Department of Immigration and Citizenship (DIAC) main website.

This information is intended for applicants wishing to migrate to Australia as the aged dependent relative, last remaining relative, or carer of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Applicants are encouraged to read Booklet 4, Other Family Migration, which can be downloaded free of charge from DIAC website or purchased from the Australian Visa Application Centres.

DOCUMENTS REQUIRED: The following is a list of documents that must be submitted in support of an Other Family Migration visa application. This list specifies the minimum documentation only and is not exhaustive. It is open to applicants to submit any documentation they wish which they believe will assist in the assessment of their application.

Completed application forms:
 Form 47OF - Application for migration to Australia by other family members (signed and dated by the applicant)
 Form 40 - Sponsorship for migration to Australia (signed and dated by the sponsor, i.e. an Australian citizen, Australian permanent resident or eligible New Zealand citizen)

 Consent to Obtain Personal Information, signed and dated by the applicant

Documents relating to the applicant(s):
 Four passport size photographs (4cm x 6cm) of each applicant. Photographs must not be more than 6 months old
 Certified copies of each applicant’s passport or travel documents, if any
 Certified copies of all pages of current Household Registration Book
 Certified copies of Birth Certificate(s) for each applicant
 Original Curriculum Vitae certified by the local People’s Committee for each applicant aged 16 years or over (no more than 6 months old)
 Certified copy of Identity Card for each applicant aged 15 years and over
 If previously married, engaged or living in a de-facto relationship - a written statement which clearly states the name(s) and date(s) of birth of previous partner(s), the time period of the relationship and a list of any children born from the relationship(s)
 If previously married - certified copy of Divorce Certificate(s) or Death Certificate(s)
 Certified copy of Marriage Certificate, if married
 If unmarried (i.e. widowed, divorced, or never married) - an original Single Status Certificate which shows that the applicant is not married
 Original police certificate of No Criminal Record issued by the local Service of Justice for each applicant (and non-migrating dependent child) aged 16 years or over. Applicants who have lived in any other country for 12 months or more in the last 10 years, must provide police certificates from those countries

Documents relating to the sponsor:
 Certified copy of the sponsor’s Australian passport or Australian residence visa or New Zealand passport
 If the sponsor was not born in Australia, a certified copy of the visa used for their initial entry to Australia
 Certified copy of the sponsor’s Birth Certificate, or if unavailable, a statutory declaration showing the sponsor’s full name, place and date of birth and full names of parents
 If the sponsor has changed name, a certified copy of the evidence of name change

Documents relating to the children of the applicant:
 Evidence of custody and access arrangements for all children under 18 years of age
 A written declaration by the non-migrating natural parent of any child under 18 years of age included in the application, allowing that child to migrate to Australia. The signature of the natural parent and the content of this declaration must be certified by the local authorities, and it is accompanied by a certified copy of that parent’s ID card and household registration
 Certified copies of birth certificates for each non-migrating child under 18 years
 Four recent passport size photographs (4cm x 6cm) for each non-migrating child under 18 years
 Form 47A - Details of child or other dependant family member aged 18 years or over for each dependent child aged 18 years or older (whether migrating or not), evidence to support their claims of dependency

 Original Single Status Certificates for each child aged 18 years or over included in the application
 Certified copies of the official Decision on Recognition of a Child Adoption (including a Record of Receipt and Handing-over a Child Adoption for any adopted children included in the application
 If one parent is unknown, decision by a local District Court stating that no person other than the known parent or guardian has any rights in connection with the child
Documents relevant to each visa category:
If you apply for a BO – 114 (Aged Dependent Relative) visa:
 Evidence of financial support the sponsor provided to you during the five years immediately before you apply (money transfer receipts, bank statements etc)
 Evidence of financial support received from any other sources

If you apply for a BO – 115 (Last Remaining Relative) visa:
 Statutory declarations from applicant and sponsor outlining:
     - Family composition and the whereabouts of all members
     - Full names of all your parents, siblings, and children (including step-       family and foster- family) including those you claim to be deceased or missing
     - When and where those family members who are claimed to be deceased or missing were last in contact with you
     - A decision from the local District Court confirming that the relatives are deceased or missing
     - Evidence of any attempts that have been made by your sponsor to trace these missing relatives through any official channels and evidence of any correspondence detailing your sponsor’s efforts
 A statement about what contact you have had with overseas relatives living in countries other than Australia
 Applicants statutory declaration outlining the family composition of their spouse:
     - The circumstances of the parents of your spouse (including any former spouse). If the parents of your spouse (or former spouse) are claimed to be deceased or missing you should provide copies of Death Certificates or a decision from the local District Court confirming that the relatives are deceased or missing
     - If your spouse has previously been divorced or separated you should provide a statutory declaration regarding his/her family composition and provide details of spouses children, if any
     - If any of your spouse’s children are missing or dead, you should provide certified copies of Death Certificates or a decision from the local District Court confirming that the relatives are deceased or missing
     - Details of whether or not your spouse has any siblings. If any of the spouse’s siblings are missing or dead, you should provide certified copies of Death Certificates or a decision from the local District Court confirming that the relatives are deceased or missing

If you apply for a BO – 116 (Carer) visa:
 Original Certificate of Assessment from Health Services Australia for Carer Visa
 Original report from Medical Adviser, Health Services Australia for Carer Visa
 Statutory declarations from relatives living in Australia stating the reason why they can not provide care to the person requiring care and evidence to support these statements
 Copies of any correspondence with organisations regarding alternative care arrangements
 Statement from an appropriate authority, such as a social worker or doctor employed at the hospital where the person requiring care has received treatment, stating
     - why the local care facilities are not available or adequate, and
     - how long it is envisaged that person could remain in the home environment if there is full time home care.
 Statement from the applicant regarding his/her ability to provide the required care
